Ismail and Co Court of Appeal

MM (Zimbabwe) v Secretary of State for the Home Department: [2012] EWCA Civ 135 Ismail and Co were successful in challenging a decision of the Upper Tribunal (Immigration and Asylum Chamber) to dismiss the appellant’s appeal. The Court of Appeal allowed the appeal to the extent that they remitted it to the Upper Tribunal. This case raises an important point with regards to the limits of “conspicuous unfairness” as a ground of challenge.
